Online platforms have dramatically escalated the scale and complexity of counterfeiting and dupes, creating a very different story to their historical selves; it is now a new beast altogether. If you go to any live sports game, I can guarantee a large portion of the jerseys you will see the fans wearing are indeed dupes and counterfeits. I must confess that when I was young, my friends and I would make large jersey orders from foreign websites because the larger the order, the cheaper the shipping.
Now? The Super Bowl is airing adverts for prevalent and well-known dupers, and it’s as if it has become the norm. How can we fight back against this monster of a movement?
Dupe vs. Counterfeit: Understanding the Difference
Well, the first and most important way is to know the difference between a dupe and a counterfeit. Dupes, unfortunately, you see absolutely everywhere, and for a large majority of them, they are 100% legal. Say you go into a CVS store and see bandages; do you go for the more expensive but well-known Band-Aid brand bandages or do you go for the CVS home-branded bandages? Most people I know will always save a few cents these days and select the home brand.
CVS isn’t counterfeiting Band-Aid; they made a competing dupe with the same function as the competitor, just at a cheaper price. However, sometimes products have patents on their design or packaging, and this will cause legal issues for those who replicate a brand “identity”. This is where dupes become more tricky. While many sellers hit snags here, you will often see tiny discrepancies designed to be just different enough to avoid legal alarms, even if they don’t offer the same trusted quality.

This is where counterfeits come in. Counterfeits are meant to look as identical as possible to the original product. Remember when my friends and I would buy sports jerseys in bulk? 99% of them had defects, but we didn’t care because we got them for $20 and most people we knew had fakes as well.

Counterfeiters tend to rely on major online retailers, but they also create their own websites that replicate the company they are ripping off—building sites that are almost a “T” the same as the original. They even piggyback on original brands’ advertising, redirecting consumers to the “fake” website. This fools consumers into thinking the sites are legit. When they purchase from these scam websites and realize they didn’t get the product (or sometimes anything at all), they lose trust in the brand—even though it’s not the fault of the original company.

The second issue is the current economic climate and the impact this is having. Consumers ask themselves, “Why should I care about originality if I am saving money?”
I get it. Especially today, when everything costs more and everyday purchases are turning into monthly luxury purchases. However, the issue consumers often ignore is that counterfeit products pose severe health and safety risks. Counterfeit electronic products, for example, can have a 6.17% failure rate as opposed to legitimate products which are less than 0.01%. “You get what you pay for” is an understatement.

Since counterfeiters moved into the skincare and cosmetics industry, the situation has become worrying. Counterfeit ingredients are completely unregulated. Tests have shown stabilizers like animal urine and harmful carcinogens such as arsenic, beryllium, and cadmium. As a consumer, risking your health is not worth saving a few bucks.

So what can we do? Brands may perceive being counterfeited as a badge of honor or confirmation of their eliteness. In reality, their problems have just begun. Complaints, bad reviews, and negative word-of-mouth follow quickly. I can promise any brand manager that it’s a lot easier and safer to plug the counterfeit leak in the beginning, long before it becomes a raging river.
